DEFINITIONS:

"Terms and Conditions" means these Terms and Conditions.

"Supplier" - shall mean the trading company "KUIUMDJIEV-1925" Ltd. registered in the Commercial Register at the Registry Agency under UIC 104674321. Detailed information about the Supplier and details on how to contact the Supplier can be found below in the General Terms and Conditions.

"Website" - means an Internet address

"User" - means the persons using and visiting the Website and the Online Shop.

"User Profile" - means a separate section on the Website containing information about the User, provided by the latter when registering on the Website.

" E-shop" - means the electronic shop of the Provider, which is located on the Website.

" Product(s)" - means the goods offered by the Supplier through the Online Shop.

"Order" - means the User's order for certain Products selected by him/her, together with the chosen method of payment and receipt of the Products.

""Product Price" - means the price per unit or per specified quantity of Products, quoted in Bulgarian Leva when the Website is accessed in Bulgarian and in Euros when accessed in English, including value added tax and any additional taxes and charges. The price does not include transport and delivery costs.

"Delivery Price" - means the cost of transport and delivery of the Products to the User, including value added tax.

"Contract" - means the contract concluded remotely between the Seller and the Buyer for the purchase of Products and/or Services from the Website, an integral part of which are these Terms and Conditions of Use.

"Specifications" - all features and/or descriptions of the Products and Services as set out in their description.


I. ONLINE PURCHASE OF PRODUCTS

1. The Supplier shall provide Goods remotely to Users through the Website and the E-shop upon payment after the User's explicit statement.

2. In exchange for the Products provided by the Supplier, the User shall pay the Price of the Order in accordance with the Terms and Conditions of the General Terms and Conditions and any amendments to the latter that are published on the Website. The User expressly declares that he/she is aware of the fact that any Order in the E-shop and on the Website involves an obligation of payment.

3. The Supplier reserves the right to unilaterally change the Products, their parameters and characteristics, as well as unilateral changes in the General Terms and Conditions, for which it is obliged to inform Users by publishing information on the Website. The Supplier shall have the right to unilaterally change all terms of delivery of the Products and any other information available on the Website without prior notice to the User.

4. The General Terms and Conditions may be updated and changed at any time without any special notice to Users. The Supplier shall not be liable in the event that Users are not aware of subsequent updates to the Terms and Conditions published on the Website.


II. REGISTRATION OF USER PROFILE

1. The Website and the E-shop can be browsed by visitors freely, without registration.

2. Registration is done by filling in a registration form in real time by the User. The fields that must be filled in are marked with "*". The User agrees and declares to provide true, accurate, current and complete information when completing the registration form. Upon registration, User agrees to voluntarily provide the personal information required in the registration form. "KUIUMDJIEV-1925" Ltd. may change the required personal data for registration on the Website at any time. In the event of a change in any of the data on the registration form, the User shall, within 3 / three / days of the change, update the relevant data in the User Profile.

3. In the event that the User provides false, inaccurate, outdated or incomplete information, the Supplier shall have the right to close and/or delete the relevant information and deny the User further access to some or all of its services, or to delete the registration in its entirety and terminate this Agreement without prior notice. The Provider shall not be liable for any incorrect and/or inaccurate Order made in connection with the information received from the User. The Supplier shall not be liable for not delivered Orders or other non-performance due to outdated information and re-shipment of Products shall be borne by the User.

4. When registering on the Website, the User shall provide an e-mail address and password to access the User's account. The User is fully responsible for the protection of his/her e-mail address and password and for the actions of third parties with the same. The User should end each session in the User Profile by logging out of it, for security and data protection reasons. In case of suspicion of illegal or unauthorized access, stolen or lost e-mail and/or password, the User should notify the Provider immediately in order to suspend access to the User's personal information and avoid unauthorized actions with the User Account.

5. By registering and creating a User Profile, the User gives his/her express consent for the personal data he/she has entered during registration and subsequently changed/added to, to be used and stored by the Provider for the purposes set out in the General Terms and Conditions.

6. The User Profile provides the User with the ability to view and edit the data entered at registration at any time, as well as provides full access to all his Orders, the ability to unsubscribe from information messages, brochures, newsletters and other similar.

7. The User again expresses his will to agree to the General Terms and Conditions by selecting the "I accept the General Terms and Conditions" box and subsequently clicking the button to confirm the registration. By selecting the "I accept the Terms and Conditions" box, the User makes an electronic statement within the meaning of the Electronic Document and Electronic Signature Act, by which he declares that he is familiar with the Terms and Conditions and accepts them in full. Upon saving of the statement under the previous article by the Provider, the electronic statement also acquires the status of an electronic document within the meaning of the Electronic Document and Electronic Signature Act.

8. A User Account may be closed at any time at the request of the User.


III. PRODUCTS AND ORDERS

1. Placing Orders and concluding Purchase Contract(s) with the Supplier may be done without registration of a User Profile. By placing an Order without registration, the User gives his/her explicit consent for the personal data entered in the Order to be used and stored by the Supplier for the purposes specified in the General Terms and Conditions. The fields that must be filled in to complete the Order are marked with "*". The User agrees and declares that he/she will provide true, accurate, current and complete information when filling in the details to place an Order without registration. The User agrees to voluntarily provide the personal data required in the form to place an Order without registration. "KUIUMDJIEV-1925" Ltd. may at any time change personal data required for placing an Order without registration. In the event that the User provides false, inaccurate, outdated or incomplete information when placing an Order without registration, the Supplier has the right to deny the User further access to some or all of its services. The Supplier shall not be liable for any incorrect and/or inaccurate Order made in connection with the information received by the User when placing an Order without registration. The Supplier shall not be liable for not delivered Orders or other failures due to incorrect data and re-shipment of Products shall be borne by the User.

2. The E-shop accepts Orders 24/7. The User has the right to order all the Products listed on the Website. When placing an Order, the User has the right to choose the type of Products and their quantity, the method and terms of delivery, according to the options offered on the Website.

3. Each Product on the Website is supported by information on the Price of the Product, the main features of the Product and additional information provided to help Users make an informed choice when purchasing. The Supplier shall not be liable for any inaccuracies in the description of the Product which do not relate to the main characteristics of the Product and does not claim the completeness of the information provided.

4. All prices quoted on the Website are in Bulgarian leva when the Website is accessed in Bulgarian and in euro when accessed in English and with value added tax included. In case the Product has several types, the prices for each of the types are indicated. The Supplier may change the prices indicated on the Site at its sole discretion, at any time and without being obliged to notify the Users in advance. The User is obliged to pay the price that was indicated on the Website at the time of placing the Order, whether lower or higher than the updated price.

5. The Supplier may at any time and without notice make changes to the published products, prices and other characteristics of the Products and Users shall be deemed to be informed of the said changes from the date of their publication. The information for some of the published Products may not have been updated, but in any case Users will be notified, in the case of an Order, prior to delivery, of the non-updated information on the Website relating to the ordered Products. Some of the information published on the Website may relate to Products that are not currently offered or available, for which we ask you to excuse us in advance.

6. Each selected Product is placed in the User's virtual shopping cart. Until the Order is confirmed, the User may view and change the Products ordered, quantities, method of payment and other data related to the specific Order.

7. The Order is placed by following the following basic technical steps:

- View the Products;
- Adding Product(s) to the User's virtual shopping cart;
- Filling in User's details;
- Enter the delivery address;
- Confirmation of payment method;
- Finalizing the Order;
* Ability to issue an invoice, after entering all the necessary data.

8. Upon finalization of the Order and its confirmation by the User, the latter undertakes to pay the Price of the Order and again declares that he is aware of the fact that the Order is related to a payment obligation. After the finalization and confirmation of the Order by the User, the system of the E-shop automatically sends an information e-mail confirming the receipt of the Order in the system of the Supplier.

9. Users understand and agree that it is possible that certain Products may not be available at the time of placing the Order. In the event that the Supplier is not able to complete the Order due to the fact that the Product is out of stock, the Supplier shall notify the User about the shortage of the Product by calling the telephone number indicated by the User or by sending a message to the e-mail address indicated by the User. The notification shall be made within 48 hours of receipt of the Order. Where the Order is received on a non-working day or the 48 hours specified expire on a non-working day, notification shall be made by the end of the first working day. In such cases, the Supplier shall refund the Customer in full the amounts paid by the Customer for the purchase of the Products if the same have been prepaid.

10. If, within 2 /two/ days of receipt of an Order, the Order Price has not been received in the Supplier's bank account (where payment by debit/credit card or bank transfer has been selected), the Order shall be considered automatically cancelled and the Supplier shall not be liable for any performance thereunder.

11. The Supplier may request further confirmation, including by telephone or e-mail of the Order. If the User refuses to provide the information/confirmation requested by the Supplier, the refusal to provide such information/confirmation shall automatically result in the cancellation of the Order with or without further notice to the User.


IV. DELIVERY OF THE PRODUCTS

1. The products shall be delivered by a courier company.
The products shall be delivered to the address specified by the User or to the office of a courier company within or outside the territory of the Republic of Bulgaria.
* Users may choose to pick up the ordered Products in the Supplier's physical store.

2. In case of impossibility of delivery at the first visit to the address indicated by the User, not due to the fault of the Supplier and/or the courier (in case there is no one at the address, etc. similar), the person making the delivery leaves a notice specifying a phone number to which the User should call within 2 /two/ working days in order to specify a new deadline for delivery. In case of failure to deliver and in the event of a second visit not due to the fault of the Supplier and/or the courier, the contract for distance selling shall be automatically terminated and the Supplier shall be released from its obligation to deliver the ordered Products, in which case, as a penalty for non-performance by the User, the Supplier shall retain all amounts paid by the User. The provision of the above sentence shall also apply to cases where the User refuses to accept a delivery without valid reason.

3. The terms of delivery of the Goods shall be as follows:
For deliveries within the Republic of Bulgaria: from 1 to 3 days*
For deliveries outside Bulgaria the term shall be determined depending on the location of the User.

* In all cases, the Supplier has the right to extend the specified delivery time by up to 10 / ten / working days, to which the User agrees when finalizing the Order.

Terms of delivery may be extended on public holidays and/or weekends by the period of non-working days.
If the User selects cash-on-delivery as the payment method, the delivery terms shall start from the date of receipt of the e-mail referred to in Section III, point 8 of the General Terms and Conditions. If payment by bank transfer or debit/credit card is selected, the delivery terms shall commence on the date of receipt of the Price of the Order in the Supplier's bank account.

4. Price for delivery:
- KUIUMDJIEV-1925 Ltd ("Supplier") shall deliver any products ordered using a third party courier.
- KUIUMDJIEV-1925 Ltd shall use courier services. The price is determined by the location to which the goods are sent and the weight of the product.
- In case of return/cancellation (not valid for ordering personalized jewellery) after reviewing the package, the return fees are borne by the User.

5. The Supplier shall not be liable for delay in case the delay is due to the fault of the courier making the delivery and/or due to circumstances beyond the Supplier's control.

6. Upon delivery, the Products shall be carefully checked by the User and/or a person authorized by the User. In the event of any apparent defects, the absence of any of the accessories accompanying the Products and/or any of the documents required by Bulgarian law, the User shall immediately inform the person making the delivery, for which a protocol shall be prepared. In addition, the User shall immediately notify the Supplier at e-mail: office@kuiumdjiev.com. If the User fails to do so, the Product shall be deemed to have been approved and the User shall no longer have the right to later claim that the Product was delivered to him/her with obvious defects, lack of any of the accessories accompanying the Product and/or lack of any of the documents required by Bulgarian law. Claims for goods purchased through the E-shop shall be made in accordance with the rules of the Consumer Protection Act, and in addition the User shall notify the Supplier at e-mail: office@kuiumdjiev.com for each claim, attaching the relevant invoice/receipt for the purchased Products or indicating its number and date.

7. Upon delivery of the Products, the User or a third person designated by the User shall sign the documents accompanying the Products. A third party shall be deemed to be any person who is not the Order Holder but accepts the Products on delivery to the delivery address specified by the User.

8. The couriers that carry out the delivery of the Products shall be selected at the discretion of the Supplier and the Supplier may change them at any time without being obliged to inform the User in advance, as long as this does not affect the method and time of delivery.


V. WITHDRAWAL FROM A DISTANCE CONTRACT AND PURCHASED GOODS

1. On the basis of Art. 50 of the Consumer Protection Act /CPA/, a User who has the capacity of a consumer within the meaning of the Consumer Protection Act has the right to withdraw from the distance sales contract and to request the return of the ordered and purchased Products within 14 (fourteen) days from the date of receipt of the Products by the User or a third party, other than the carrier and designated by the User, or where the User has ordered multiple Products with a single order, which are delivered separately, from the date on which the User or a third party other than the carrier and designated by the User receives the last Product. The conditions under which the return is made are:

- The User shall notify the Supplier in advance at e-mail: office@kuiumdjiev.com that he/she is withdrawing from the distance selling contract on the basis of Article 50 of the Consumer Protection Act, where he/she shall also indicate a bank account for the refund;
- that the original packaging of the Products as provided by the manufacturer has not been opened and that its integrity has not been compromised, and that the integrity of the protective stickers and other markings provided by the Supplier has not been damaged;

In case of non-fulfillment of the above conditions, the Supplier reserves the right to refuse to accept the returned Products and accordingly not to refund the full amount paid by the User. The User has no right of refusal in respect of products and circumstances falling within the scope of Article 57 of the CPA.

2. All transport and any other costs of returning the Products shall be borne entirely by the User. Until the return of the Products by the User to the Supplier, the risk of accidental loss or damage shall be borne entirely by the User. In the event that any Product, by its nature, cannot be returned in the usual manner by post, the User shall bear the cost of returning the Products by other means and shall pay for them in accordance with the relevant tariffs, price lists, etc. of the relevant courier or other return companies chosen to be used.

3. In the event that the User exercises his right under Article 50 of the CPA, provided that he has fulfilled the above conditions, the Supplier shall be obliged to refund the Price of the Delivery (excluding additional costs associated with the method of delivery chosen by the User other than the cheapest standard method of delivery offered by the Supplier) by bank transfer (to the bank account specified in the order given above) or by cash on delivery within the statutory 30-day period. The User expressly declares his/her consent to the refund by the Supplier to be made by bank transfer, regardless of the means of payment used by the User to pay for the Orders placed. The Supplier shall be entitled to postpone refunds until the Products have been received back or until proof has been provided that the Products have been sent back, whichever is the earlier.

4.The User is obliged to fill in, a form for exercising his right under Article 50 of the CPA to withdraw from the contract.

5. The User shall send to the Supplier or return the Products without unreasonable delay and in any case not later than 14 days from the date on which the User has notified the Supplier of his withdrawal from the distance contract. The deadline shall be deemed to have been met if the User sends or hands back the Products to the Supplier before the expiry of the 14-day period. The Supplier reserves the right to refuse the return or exchange of Products, at its sole discretion in any particular case.


VI. PAYMENT TERMS

1. The Order price can be paid in one of the following ways:

- Cash-on-delivery - payment is made at the time of delivery of the Product when the courier visits the delivery address specified by the User and delivers the Product to the User. The price of the Order is given to the courier.
- By bank transfer to a bank account specified by the Supplier, prior to receipt of the ordered Product - the User should send a copy of the payment order/deposit receipt to the e-mail: office@kuiumdjiev.com, and if not able to do so should send the following information to the specified e-mail: date of payment; bank; payment order/deposit receipt number; order number; three names and telephone number.

VII. PERSONAL DATA

1. By accepting the General Terms and Conditions, Users agree that the Supplier and its employees, depending on their duties, have access to some or all of the information completed/submitted when registering a User Profile and/or ordering Products.

2. The Supplier is a registered administrator of personal data under Bulgarian legislation and ensures its protection in accordance with the Personal Data Protection Act and related regulations. By accepting the General Terms and Conditions, Users agree that the Supplier may process the personal data provided for the following purposes:
- technical management of the Website and the E-shop and their databases;
- contacting Users;
- Order management, delivery of Products and any other activities related to the performance of the Supplier's and Users' obligations;
- measuring the effectiveness of the Supplier's services;
- advertising campaigns, marketing and market research, pricing;
- sending promotional offers and materials, information about the Supplier's products and other similar information by post, telephone and/or e-mail; direct marketing;
- any other commercial messages.

3. On the basis of Article 34a of the Personal Data Protection Act, Users may object to the use of their personal data, their disclosure to third parties and their use on their behalf for the aforementioned purposes. You have the right to object to the processing of your personal data for direct marketing purposes by sending a written request to the Supplier at the contacts listed at the end of the Terms and Conditions. At the same locations you can contact us in case of unauthorized completion of your personal data by third parties, as well as for other possible problems.

4. At any time, you may unsubscribe from receiving information about products, campaigns, promotions, etc. of the Supplier, as well as from receiving other advertising and information materials and offers by sending a e-mail to office@kuiumdjiev.com.

5. By accepting the General Terms and Conditions, the Users expressly consent to the Supplier sending them to the provided address, e-mail and telephone number specified in paragraph 2 of this Section V, commercial messages, information, materials, etc. This shall also be deemed to be prior consent within the meaning of Article 6(4) of the E-Commerce Act and Article 49 of the Consumer Protection Act.


VIII. OTHER PROVISIONS

1. In the event of disputes arising out of or in connection with the Terms and Conditions, the parties undertake to endeavour to resolve them in a spirit of understanding and mutual compromise. If the parties are unable to reach an agreement, the dispute between them shall be finally settled by the competent Bulgarian court.

2. The provisions of Bulgarian substantive law shall apply to all matters not covered by these General Terms and Conditions.

3. The Supplier shall use its best efforts to keep the information on the Website and the E-shop always correct and up-to-date, but does not guarantee its completeness and reliability.

4. The Supplier assumes no liability for failure to perform its obligations under this Agreement in the event of circumstances which the Supplier did not foresee and was not obliged to foresee, including but not limited to cases of force majeure, fortuitous events, problems in the global network of the Internet and in the provision of services beyond the control of the Supplier.

5. The Supplier does not guarantee uninterrupted, timely, secure and error-free access to the Website and the E-shop to the extent that this is beyond the Supplier's control and capability.

6. The Supplier shall not be liable for any damage caused to telecommunications facilities, software and hardware, or for any loss of data resulting from materials or resources used in any way through the Website.

7. It is forbidden to copy, publicly distribute, display or distribute materials, photos, logos, images and other similar published on the Website for any purpose by the Users. Violators are subject to penalties under the provisions set forth in the Copyright and Related Rights Protection Act and the Trademarks and Geographical Indications Act.

8. The goods for which the Supplier provides commercial warranties and the conditions thereof are specified in the E-shop. The Supplier shall have the right to change the terms of the commercial guarantees and the Products for which they are provided at any time.
